PRS – Save for retirement and enjoy tax relief too

RETIREMENT could be the best chapter of your life when you have the time and resources to do the things you have always wanted to do with people closest to you.

Complying with Malaysia’s regulatory framework on cloud services

MALAYSIA’S commitment to integrate cloud services is profoundly reshaping its regulatory framework. Under the MyDIGITAL initiative, the Malaysian government has embraced a “Cloud First Policy”, marking a strategic pivot to enhance dependence on cloud services.

This transformation has reinforced regulatory requirements for cloud services in Malaysia, to guarantee robust data security and privacy for all cloud consumers.

Under the regulatory framework governing the communications and multimedia industry, as established by the Communications and Multimedia Act 1998 (CMA), two main licence categories exist: individual licences, subject to rigorous regulatory control and foreign ownership restrictions; and class licences, designed for easier market access without such restrictions.

Within these principal categories, the CMA provides four sub-categories of licensable activities, one of which is the Applications Service Providers (ASP) licence, which is issued by the Malaysian Communications and Multimedia Commission (MCMC).

Historically, the CMA did not require specific licences for cloud service providers. However, in 2022, the MCMC, recognising the need to ensure data security, introduced the ASP Class – ASP(C)) – licensing requirement for cloud service providers.

For regulatory purposes, the MCMC defines “cloud services” as “any service accessible to end-users via the internet from a cloud computing provider’s server”.

Under the CMA, cloud service categories requiring licensing are Platform-as-a-Service (PaaS) and Infrastructure-as-a-Service (IaaS). The Software-as-a-Service (SaaS) category is exempt as it relies on other cloud service platforms or infrastructures.

ASP (C) licensing is applicable to locally incorporated cloud service providers and data centres offering cloud services to end-users, in the following scenarios - when a locally incorporated company provides PaaS or IaaS cloud services to end-users in Malaysia; when a locally incorporated company offers PaaS or IaaS cloud services for resale by an agent to end-users in Malaysia; and when a local data centre facilitates foreign cloud providers in delivering their PaaS or IaaS cloud services to end-users in Malaysia.

However, in certain scenarios, an ASP(C) licence is not required. For example, when a foreign cloud service provider operates in Malaysia without local incorporation or through a branch, and provides PaaS or IaaS cloud services directly to end-users; or when a locally incorporated company offers SaaS cloud services using outsourced PaaS or IaaS providers; or when agents resell such services from CMA-licensed providers to end-users in Malaysia.

Upon being granted an ASP(C) licence, the cloud service provider is bound by a spectrum of legal obligations. These include complying with legislative instruments under the CMA; indemnifying the minister and the MCMC against any claims resulting from the licensees’ breach of applicable regulations; ensuring safety measures on equipment used; maintaining accurate charging mechanisms; and annual re-registration. Further, all CMA licensees must hold a valid data user registration certificate under the Personal Data Protection Act 2010.

Cloud service providers serving Malaysian financial institutions must be aware of cloud adoption requirements issued by Bank Negara Malaysia (BNM) for financial institutions.

From June 1, 2024, financial institutions must consult BNM prior to first-time adoption of public cloud services for critical systems, and must perform comprehensive risk assessment before deploying such cloud services. This assessment, guided by the central bank’s criteria, necessitates effective oversight over cloud service providers and entails establishing continuous monitoring mechanisms; defining clear accountabilities; conducting periodic assessments; emphasising business resilience and data security; and promptly adapting to changing risk profiles. Cloud service providers must collaborate with financial institutions to fulfil these obligations by providing transparent and proactive communication about any changes impacting outsourcing arrangements.

Cloud service providers should be aware that financial institutions must safeguard customer information and proprietary data when using cloud services, such as by controlling the management of such data, including managing the cryptographic keys. To support compliance with these requirements, cloud service providers can offer solutions such as encryption, access controls, security assessments, and robust disaster recovery planning.

The dynamic growth of Malaysia’s digital economy demands heightened regulatory oversight, which is exemplified by the introduction of ASP(C) licensing requirements and the enhanced risk assessment process for financial institutions considering cloud adoption.

Given the current digital landscape, it is imperative for cloud service providers to ensure compliance and proactively seek legal counsel to navigate regulatory changes effectively.

HP Malaysia focuses on gaming, peripherals and workforce solutions

PETALING JAYA: HP Malaysia’s focus areas going forward will be in gaming, peripherals and workforce solutions in alignment with the country’s digital trans-formation agenda, according to its managing director, Alex Tan.

“Aligning with Malaysia’s Industry 4.0 policy and showcasing HP’s dedication to innovation, technology and creativity – our strategy will focus on gaming, peripherals, and workforce solutions,” he told SunBiz.

On gaming he explained, “With gamers refreshing PCs twice as fast and our acquisitions of HyperX and Poly uniquely position us to provide end-to-end hybrid and conferencing experiences crucial for today’s information technology decision makers and chief investment officers.”

In addition, he said the company anticipates the evolution of artificial intelligence (AI), virtual reality (VR) and augmented reality (AR), and it is committed to meeting the new demands for immersive technology and the metaverse.

“We’ve reflected this in some of HP’s technology such as Poly and Spectre Fold, and consumers can expect more from HP in the next few years,” Tan said.

He stated that the HP Experience Hub at Pavilion Bukit Jalil is HP’s first innovative concept store in Southeast Asia aimed at integrating a hyperpersonalised omnichannel commerce platform locally enhancing engagement with customers.

Recognising the vital role of SMEs in Malaysia’s growth, he said, HP is actively playing a role in fostering sustainable business success. “For instance, HP’s Penang hub emphasises local partnerships, with 70% of suppliers being Malaysian entities.”

He added that in 2022, HP invested US$1.6 billion (RM7.4 billion) in developing technologies that are set to reshape the future, reflecting HP’s core values and resonating with the growing demand for sustainable practices from employees, customers, and investors worldwide.

With this, Tan said, the company is targeting US$1.4 billion in annualised savings worldwide by financial year 2025, by pursuing operational excellence, digital transformation and cost efficiency.

“As part of our ‘Future Ready’ operations, we’re not just focused on innovation but also on efficiency,” he added.

Furthermore, Tan mentioned Malaysia’s endorsement of the 2030 Agenda for Sustainable Development, indicating that HP aligns its efforts with the initiative aimed at addressing various challenges and promoting sustainable development.

“At HP, we go beyond creating products; we drive progress too and the HP 22nd Sustainable Impact Report, showcases our journey towards a more resilient and inclusive future, centered on Climate Action, Human Rights, and Digital Equity,” he said.

HP’s recent innovations include HP Spectre Fold, a hybrid three-in-one with a foldable screen and AI-powered personalisation; HP Envy Move All-in-One, the world’s first cordless, movable All-in-One PC; and HP Pavilion Plus, engineered for robust performance, heavy workloads, and immersive entertainment, designed for the younger generation in Malaysia.

For SMEs, it has introduced the HP Smart Tank 520 and 580 series, enabling scanning and printing from anywhere through cloud printing in the HP Smart App

In office printing, the HP LaserJet Managed MFP E800/700 series integrates advanced features for enhanced data security, while the HP Color LaserJet Enterprise 5000/6000 series transforms workflows, boosts productivity, and offers scalable document management at high speed.

Meanwhile, HP OMEN 16 and HP Victus, gaming laptops with AI-powered technologies, showcase OMEN Tempest Cooling and high-end processors.

Nefin targets 100MW of solar power projects in Southeast Asia next year

PETALING JAYA: Nefin Group – an independent power producer specialising in green energy – aims to secure 100 megawatts (MW) of solar power projects across Southeast Asia in 2024 with Malaysia expected to contribute more than 30% of the total, driven by an increase in its market penetration and market share, said regional managing director and group business development head Chong Bor Hung.

In an exclusive interview with SunBiz, Chong estimated that the projects translate to about RM46 million or US$10 million in revenue.

He remarked that long-term contracts of around 20 years will provide a steady stream of revenue for the company over their duration.

In 2023, the company secured projects in Southeast Asia totalling more than 70MW.

Recently, the Malaysian Energy Commission selected the company as one of the solar power producers for the Corporate Green Power Programme (CGPP). The company will develop a 45MWp solar farm project in Teluk Intan, Perak, as part of this initiative, with an estimated cost of RM130 million.

“That was a big step in our strategy for the next two years at least, until 2025. In Southeast Asia, with Malaysia being the bulk of it, the business is (expected) to scale at 100 megawatts per year.

“Originally, we were dominant in the rooftop solar business and with CGPP that we’ve secured, we are now on track to doing utility-scale projects and we expect to get more next year. We do expect to see continued growth and presence of our company in the commercial and industrial business, but the scaling of the business is going to largely come from utility scale business as well,” Chong said.

He explained that utility-scale projects would have a development lead time of two to three years. Hence, in order to get a utility scale project built in 2025, development would have started since 2023.

“It’s like any big infrastructure projects, the development time takes a couple of years. We expect to be growing our order book, portfolio at a scale of about 100 megawatts per year, just in Southeast Asia but the utility-scale projects that we’ll be deploying let’s say by 2025 is the one that was secured in 2023.”

Malaysia is projected to contribute to about one-third of the projects, followed by Taiwan, and the rest will likely come from mainland China, Hong Kong, Singapore, Thailand and Vietnam.

On outlook, Chong said Malaysia has constantly shown steady industry growth in Southeast Asia. He added that despite the “fairly conservative” policies set by the government, the growth of country has been quite consistent and stable for the past eight years.

“Malaysia has been one of the more consistent markets in Southeast Asia. The growth is expected to be quite steady like the previous years. Next year, the government will potentially roll out some special projects or special mega projects in line with the National Energy Transition Plan. For the majority of the industry, I expect that the industry growth will be in line with what we’ve seen over the past few years,” he said.

While Chong commended the government for the various initiatives it implemented to spearhead its green agenda, he opined that there are other methods the government could look into towards accelerating decarbonisation of the Malaysian grid, namely through the liberalisation of the local energy market and easing technical restrictions.

“First, the liberalisation of the energy market would be great, allowing for more things like third party access, direct sale of electricity between power plant developers and the consumer. (It would enable) for more freedom and transparency in transactions.

“Second is lifting of technical restrictions on the capacity and the licence approval processes for projects in Malaysia ... lifting some of the technical restrictions on the solar system capacities will also allow for greater scale installations and will lead to a higher penetration of renewable energy into the grid,” said Chong.

He opined that the company is the one of the largest asset holders in terms of external projects in the country. The projects in Malaysia it has undertaken include Intel’s solar farm in Kulim, Celestica facilities in Senai, solar rooftop installation at Cadbury Confectionery Malaysia Sdn Bhd facilities, managing solar assets in 28 Lotus’s stores as well as partnering with Mydin Mohamed Holdings Bhd for solar systems installation.

On demographics, Chong said its customers are primarily in the commercial and industrial segments, with a long-term track record of strong financial performance, consisting of a significant number of Fortune 500 companies.

“For the coming year, we plan to continue with our current demographic of customers and expanding it through, for example, the type of utility-scale projects that we’re working on.”

Chong disclosed that Nefin is in talks with potential clients in the hotel and data centre space for future projects. In addition, the company plans to expand into the real estate business, he said, although he declined to share details.

CGC Digital, MDEC and PayNet team up to address RM90b MSME financing gap

PETALING JAYA: CGC Digital Sdn Bhd, Malaysia Digital Economy Corporation (MDEC), and Payments Network Malaysia (PayNet) have signed a collaboration agreement aimed at driving financial empowerment and fostering inclusivity among micro, small and medium enterprises in Malaysia through pioneering Alternative Credit Scoring solutions.

This tripartite partnership signifies a collective commitment to address a RM90 billion gap in financing for MSMEs.

The digital tool to power the bridging of the financing gap will be the Alternative Credit Scoring undertaken by CGC Digital as it explores alternative data to facilitate the development of its model. The partnership will be led by CGC Digital in providing the digital guarantee, MDEC in connecting fintech players and championing policies/frameworks, and PayNet in utilisation of its payments data.

PayNet as the national payments network has over the years aggregated a sizeable data through its product range – DuitNow (also known as Malaysia’s National QR Code), JomPAY and FPX. MSMEs that are not registered with the Companies Commission of Malaysia but may have registration under local councils could have transaction data in any of these data points.

“Collaborating with MDEC and PayNet, CGC Digital has identified potential fintech companies to embark on proof-of-concept initiatives aimed at validating the effectiveness and viability of Alternative Credit Scoring model. This initiative is aimed to empower MSMEs and bridge the financing gap by democratising access to credit guarantee and financial services in advancing financial inclusion,” said CGC Digital CEO Yushida Husin.

MDEC CEO Mahadhir Aziz said that the collaboration is a testament to their commitment to drive innovation in the financial sector and address the MSME financing gap.

“The Malaysia Digital (MD) national strategic initiative and suite of dynamic PeMangkinMD programmes aim to transform our nation’s digital capabilities, foster the growth of tech companies, and boost the digital economy. We are optimistic to facilitate more partnerships between financial institutions, fintech companies and relevant ecosystem partners with a common goal of revolutionising credit assessment methods which will be a game changer for the financial sector,” he added.

The MoU is envisaged to spark ideas to promote and scale more pilots using Alternative Credit Scoring data points among industry players. Tax Matters – Unravelling the Global Minimum Tax puzzle

THE Global Minimum Tax (GMT) is being rolled out across 135 countries, and more are expected to join in. Malaysia will be implementing GMT from Jan 1, 2025.

The intention here is to ensure that multinational enterprises pay their fair share of tax wherever they operate and generate profits.

The minimum tax that large multinationals are expected to pay should not be less than 15% on a global level. This tax only applies to multinationals with annual revenues exceeds €750 million or about RM4 billion.

Although this tax will only affect 50 or 60 Malaysian conglomerates, it has a significant impact since we have many multinational companies operating in the country whose global revenues exceed €750 million.

Many of the multinationals operating in Malaysia are enjoying tax incentives close to zero tax. The global minimum tax is going to affect their return on investments since they would not have taken this into account when they invested in Malaysia many years ago.

If the average turnover of the multinational entity is less than €10 million, and the average income of the entity is less than €1 million each year, the entity will be excluded from GMT.

The Malaysian conglomerates will have a headache. They need to carry out this calculation on a global level to see if they exceed the €750 million threshold, and they need to carry out another set of calculations at the overseas subsidiary level. The calculations are very complex and at times subjective to the interpretation of rules. Excluded from GMT rules are pension funds, government entities, non-profit organisations, investment funds, etc.

The basics

The ultimate goal here is to apply the 15% GMT on the multinational’s excess profits in the respective tax jurisdiction where the effective tax rate or the average tax rate is less than 15%. Excess profits are surplus profits after taking into account a percentage of the profits attributable to the people and the tangible assets used in the business.

Excess profits are seen by tax authorities across the world as profits prone to escape taxation or subject to minimal taxation. Examples in the past is where multinationals have used double taxation agreements, transfer pricing and special tax rulings to escape taxation around the world.

The first step is to calculate the effective tax rate of the multinational enterprise operating in any country. If it is below the 15%, the local jurisdiction will have the right to collect the differential through a top-up tax mechanism. In the event the local jurisdiction does not have the top-up tax mechanism (generally known as Qualified Domestic Minimum Top-up Tax), then the tax jurisdiction where the ultimate parent company is located will collect the differential via another mechanism called Income Inclusion Rule or in the event the jurisdiction of the parent company does not collect the differential, the other entities of the consolidated group will share the differential.

The calculation of this tax starts with the consolidated financial accounts. The revenue, income and tax costs are all obtained from the consolidated financial accounts subject to adjustments.

On revenue, the key adjustments address the difference between the financial accounts and the taxable income, adjustments to the intragroup transactions to ensure they meet the arm’s length test under the transfer pricing rules, and removing bribes/illegal payments.

Tax costs will be the tax expense in the consolidated financial accounts, but will exclude indirect taxes, payroll taxes, property taxes and taxes of a non-income nature. Taxes will include withholding taxes.

Malaysia needs single sustainability-focused ecosystem for all stakeholders: Expert

PETALING JAYA: There needs to be a cohesive sustainable ecosystem in Malaysia for environment, social and governance (ESG) principles to be fully integrated into the economy, according to Think Plus Consulting Sdn Bhd group CEO Dr Norsaidatul Akmar Mazelan.

She said Malaysia needs to form a single sustainability-focused ecosystem that embraces all stakeholders, including the private and public sectors.

“The Malaysia Will and Trust Association (MWTA) is trying to create a single platform which everyone can agree on,” she told SunBiz after MWTA’s Shaping the Future of Estate Planning Forum recently.

Norsaidatul said no single body or association should monopolise sustainability in Malaysia – rather, it needs to have a shared prosperity element for all parties.

She noted that each stakeholder has its own set of values and purposes, but if a shared prosperity element is not present, each party would only act and make decisions according to its own goals, which may not fit or “gel” with the rest of the ecosystem.

“The government’s agenda is to ensure that the private sector integrates ESG practices into its business model, which why there is ESG reporting. So, the skill in ESG is not so much of managing your business, but rather managing all your elements of sustainability,” she remarked.

In addition,Norsaidatul said sustainability should be embedded in a company’s products, processes, people, environmental as well as its own ecosystem engagement which includes its “prosperity-sustainability”.

“Knowledge, competency and attitude bring you the real meaning of transformation ... companies need to assess the project application of their ESG, - not just by looking at their reports.

“We look at the transformation that made the changes for you to fully embrace sustainability; whether you’re with the private sector or the government, the process is the same. Practices will always give you results, if you don’t practise, there are no results,” she added.

Meanwhile, Norsaidatul said estate planners should not be solely product or sales-driven, instead they should understand the needs of their clients and try to integrate ESG principles in their planning process.

“What is your concern on environment? What is your concern on people? What is your concern about your wealth? What you are contributing back .... (it’s ) not just expecting a return out of a process. So, that (ESG) element is where a mindset change must come in.

“It is a new business model, not a traditional one. That element is probably not thought about anywhere else. I hope that MWTA can help give a different perspective of why it is a new game changer and not follow the old traditional mindset,” she added.

Organised by MWTA, the forum aimed to address issues in estate planning, discuss emerging trends, challenges as well as understanding the importance of comprehensive estate planning for peace of mind and asset protection.

Alipay+, e-wallets to promote sustainable cross-border travel

KUALA LUMPUR: Alipay+, a cross-border mobile payment digital platform under Ant International, has launched a year-end campaign to promote sustainable cross-border travel with a series of incentives offered by global partners to users of Touch ‘n Go eWallet by TNG Digital (Malaysia) as well as other four leading e-wallets in Asia – Alipay (the Chinese mainland), AlipayHK (Hong Kong, China), GCash (the Philippines), and TrueMoney (Thailand).
