Tax Matters – Exercise vigilance over areas under focus by IRB

THE Inland Revenue Board (IRB) has openly come out that its main areas of focus in carrying out its enforcement activities will cover domestic transfer pricing, offshore accounts, high net worth individuals, digital economy, shadow economy, tax incentives and organisations and institutions that are enjoying Section 44(6) exemptions.

Taxpayers involved in the above need to ensure that they do not cross the line into non-compliance, tax avoidance, tax evasion, shifting profits to lower tax regimes, involved in the black economy where income is hidden and misusing the tax incentives provided.

The IRB will be looking at both individuals and corporates that are involved in the above activities and will attempt to gather data using information within its vast database and connecting it to the external data that is available in the public domain. The availability of artificial intelligence significantly assists the IRB to locate such activities and taxpayers involved.

The intention here is to, firstly, collect extra taxes and penalties and, secondly, the punishment imposed on such taxpayers should serve as a deterrent to others not to follow suit.

Offshore accounts and high net worth individuals

High net worth individuals usually have offshore accounts. The declaration of offshore accounts is now compulsory when you file your tax returns. High net worth individuals can expect queries from the IRB on the source of the income and wealth which is now located overseas. It can be a request in the form of a capital statement or how the foreign accounts were sourced or funded.

It is advisable for high net worth individuals to prepare capital statements for at least the past three years and be ready for any queries by the IRB.

Many high net worth individuals usually do not hold the offshore accounts in their name, but may hold them through layers of offshore companies and trusts. In this case, it becomes more difficult for the IRB to find out ultimately who the beneficial owners are. If those accounts are in countries which have signed up for the exchange of information, the information will be visible to the IRB.

High net worth individuals and those involved in unaccountable money hold such wealth in more opaque instruments such as cryptocurrencies, artwork, antiques, unique valuable collections, expensive watches, non-fungible tokens, etc. It is difficult for the authorities to track these investments unless upon liquidation the monies enter into the banking system.

Digital economy and transfer pricing

These are usually activities carried out by sophisticated corporates using the legal framework to shift profits to low tax or no tax jurisdictions. The taxpayers need to be prepared to defend their position that the pricing between their related parties meet the arm’s length test, and the location of the profits is supported with business substance (i.e. there are real activities to support the generation of the profits in those locations).

If the corporates cannot meet the above requirements, the IRB will challenge such actions and attempt to bring the profits back to Malaysia or remove the profits from the tax shelters available within Malaysia, for example, companies enjoying the Malaysia Digital tax incentive or other tax incentives.

The IRB is already scrutinising companies that are enjoying tax incentives as some of them may be abusing the perks by plugging in income that should not be inside the tax incentive regime. Companies enjoying tax incentives must ensure annually that they meet all the conditions of the benefits.

Section 44(6)

Institutions enjoying this exemption from paying taxes and accepting donations where the payee is entitled to a tax deduction should ensure that their objectives as agreed with the IRB which are mostly charitable are adhered to. Such institutions should not use it as a tool to enjoy a tax benefit without meeting the noble objectives.

Meanwhile, the normal tax audits and investigations are being carred out as usual. Taxpayers need to exercise much greater vigilance over their tax affairs to avoid any surprises.

MDEC wants to boost digital economy’s contribution to GDP to 25% in 2025

KUALA LUMPUR: It is important to maintain the growth of the country’s digital economy and increase its contribution to gross domestic product (GDP) from 23% last year to 25% in 2025, said Malaysia Digital Economy Corporation (MDEC) chairman Syed Ibrahim Syed Noh.

“To ensure that we meet the target, we are getting a lot of foreign investments, in the words of the prime minister and the ministers, I think that can be done and I hope we can surpass the GDP contribution by next year,” he said at the launch of Simplify Networks Sdn Bhd’s Thunderbird 5G Router on Friday.

“The Malaysian Institute of Economic Research projects that 5G will contribute significantly to our GDP in the coming years, with an estimated annual growth of 8% and this growth will extend throughout various key sectors such as agriculture, healthcare, manufacturing, and more in catalysing overall economic advancement,” he added.

Syed Ibrahim said that In conjunction with Malaysia being the chair of Asean in 2025, this will elevate the country as the preferred Asean digital hub.

“Now we have foreign investments coming in from Microsoft, Google, Nvidia and others. I think it’s going to be very reachable and it is good for the country,” he remarked.

By addressing the evolving needs of micro, small and medium enterprises, MDEC aims to fortify its position in today’s dynamic global landscape and this collaboration makes it strive to realise Malaysia’s broader vision of becoming the digital hub of Asean, Syed Ibrahim said.

Simplify Networks, a technology startup that brings the sharing economy to the broadband space, launched its Thunderbird 5G router which appears as a pioneering achievement in telecommunications technology.

Syed Ibrahim said Simplify Networks is a key partner in the MDEC Digital Agtech Ecosystem and has been granted Malaysia Digital status in March, further cementing the support for the company in promoting digital growth in the country.

“MDEC and Simplify Networks provide solutions to help farmers, livestock crops and aquaculture for effectiveness, efficiency and higher quality products through the Internet of Things (IoT),” he added.

Simplify Networks CEO Tay Yen Pei said the deployment of its products will accelerate the rollout of digital solutions and services.

“In the next three to five years, the company will connect not just people but also IoT by 5G and the need to make sure that 5G is deployed as widely available throughout the nation,” he added.

Global trading platform Webull expands to Malaysia

KUALA TERENGGANU: Sultan Mizan Zainal Abidin today officiated the Wisma Audit here in conjunction with the Sultan of Terengganu’s 62nd birthday celebration.

Meanwhile, Wan Suraya told reporters that the building, completed in 2018 on a 1.42-hectare site, is the eighth NAD building in the country and cost RM18.63 million.

She added that it now accommodates 68 Terengganu audit officers who were previously based at Wisma Persekutuan.

At the same time, she said the NAD is planning to construct the eastern zone National Audit Academy under the 13th Malaysia Plan for capacity building and human resource development for government agencies in Terengganu, Kelantan and Pahang.

Japan economy suffers worse-than-expected contraction of 0.5%

TOKYO: Japan's economy suffered a worse-than-expected contraction in the first quarter, official data showed Thursday, in further bad news for its unpopular government.

Gross domestic product in the world's number four economy shrank by 0.5 percent against market expectations of a drop of only 0.3 percent.

Exports dived 5.0 percent, after growing 2.8 percent the previous quarter, while imports fell 3.4 percent.

Compared with the first quarter of 2023, GDP fell an annualised 2.0 percent compared with a forecasted drop of 1.2 percent, according to Bloomberg News.

The economy was hit by a major earthquake on January 1 on the Noto peninsula and by halts in production at auto giant Toyota's Daihatsu subsidiary.

Japan has been flirting with recession since last year, with zero growth -- revised Thursday from an expansion of 0.1 percent -- between October and December.

In the previous quarter, from July to September, GDP suffered a major contraction of 0.9 percent, also revised on Thursday from an earlier reading of minus 0.8 percent.

- Germany overtakes -

The new data will add to pressure on Prime Minister Fumio Kishida and his government, which for months has seen poor poll ratings.

Germany replaced Japan as the number three economy in 2023 -- in large part because of the weak yen -- and is projected to be overtaken by India too.

For decades, Japan has battled stagnant growth and deflation as well as a rapidly ageing population.

Inflation, however, has picked up, allowing the Bank of Japan in March to call time on its maverick monetary policy and raise interest rates for the first time in 17 years.

Rates elsewhere remain higher however and the wide differential has added to pressure on the yen, which in recent weeks has hit three-decade lows against the dollar.

In late April and early May, the yen briefly rose sharply against the greenback, prompting speculation that Japan had intervened in the market.

Japan's currency was once regarded as a safe haven, expected to rise in value in times of global turmoil.

But that has not proved true in recent years, with the yen cratering from around 115 per dollar before Russia's February 2022 invasion of Ukraine to 160 last month.

A weaker yen is good for Japanese exporters and foreign visitors, but it makes imports and foreign travel for outbound tourists more expensive.

“The BOJ can’t ignore these GDP numbers. This is not at all the kind of situation where they can raise interest rates again right away,“ said Nobuyasu Atago, chief economist at Rakuten Securities Economic Research Institute, quoted by Bloomberg.

“I don’t think they can move in July. They will have to wait for second quarter GDP data to come out in August.”

Honda doubling investment in EVs to $65b

TOKYO: Honda announced plans Thursday to double investment in electric vehicles to $65 billion by 2030 as the Japanese auto giant seeks to go fully electric.

The company is aggressively pursuing a target set three years ago of achieving 100 percent EV sales by 2040.

In April, it announced the largest auto investment in Canada's history with a new US$11 billion EV battery and vehicle assembly plant.

The company also has a partnership in EVs with Sony, and is exploring collaboration with rival Nissan as they face a “once-in-a-century” upheaval in the car industry.

Analysts have said the move is aimed at catching up with Chinese EV competitors as Beijing-backed automakers such as BYD speed ahead of global rivals.

“Honda is planning to invest approximately 10 trillion yen in resources... through 2030, when the period of full-fledged popularisation of EVs is expected to start,“ a statement said.

The automaker had previously allocated five trillion yen to EV tech in the medium-term.

Honda wants to “establish a competitive business structure with an aim to reduce overall production cost by approximately 35 percent”, it said Thursday.

And “as of 2030, Honda will reduce the cost of the battery to be procured in North America by more than 20 percent compared to the cost of current batteries”.

By 2030 the company is aiming for electric vehicles and fuel-cell EVs to account for 40 percent of global sales.

The world's auto giants are increasingly prioritising electric and hybrid vehicles, with demand growing for less polluting models as concern about climate change grows.

At the same time, however, there has been a slowdown in the EV market on the back of consumer concern about high prices, reliability, range and a lack of charging points.

China overtook Japan as the world's biggest vehicle exporter in 2023, helped by its dominance in electric cars.

When Honda released its earnings last week, it said it expected overall vehicle sales in the United States and Japan to grow this financial year, but predicted sales in the rest of Asia would ease.

Honda plans to produce around two million EVs per year by 2030.

Its bigger rival Toyota aims to sell 1.5 million EVs annually by 2026 and 3.5 million by 2030.

Toyota is also hoping to mass-produce solid-state batteries, a potentially hugely important technological breakthrough that could mean faster charging times and greater range.

Malaysia’s IPI growth slows in March, but manufacturing recovery remains intact

KUALA LUMPUR: Although Malaysia’s Industrial Production Index (IPI) slowed in March at 2.4% compared to 3.1% in February, it had surpassed expectations with manufacturing recovery remaining intact, said Kenanga Research.

In a research note today, the research house said manufacturing performance is expected to improve, driven by further improvement in external demand, backed by the technology sector’s upswing and China’s economic recovery.

It noted that the IPI recorded a decline of 0.2% following contractions across both mining (-1.8%) and electricity production (-3.1%), and growth was also dragged down by softer manufacturing production (+0.3%) compared to February (+0.9%).

“Notably, it said the latest Manufacturing Purchasing Managers’ Index (PMI) reading points to a stabilisation in April, at 49.0 points, compared to 48.4 in March, nearing the 50.0 neutral level, while the domestic-oriented industry is expected to remain robust, supported by resilient domestic demand.

“This is fueled by increased tourist arrivals and spending, along with stable labour market conditions. The average unemployment rate is projected to decrease to 3.2 % in 2024, compared to 2023’s 3.4%),” it said.

“Likewise, we maintain our first quarter 2024 Gross Domestic Product (GDP) growth target at 3.3%, slightly lower than the advanced GDP estimate by the Department of Statistics Malaysia at 3.9 %. Overall, our growth forecast remains at 4.5 to 5.0% in 2024,” it said.

Meanwhile, Hong Leong Investment Bank Bhd (HLIB) said that the global manufacturing PMI eased to 50.3 in April compared to 50.6 in March, but it is still in expansionary territory.

In a research not, it said Malaysia’s manufacturing index gathered slight momentum largely due to stronger export-oriented production while domestic-oriented production slowed.

“The growth of new business was supported by an uptick in new export orders, marking the first upturn in international trade volumes in over two years.

“Going forward, recovery in external demand is expected to benefit Malaysia’s export-oriented manufacturing sector, while the domestic-oriented sector will continue to be supported by resilient consumer spending and further implementation of projects,” it added.

Tax Matters – Dispute Resolution Panel a useful avenue for resolving disagreements

THE Dispute Resolution Panel (DRP) was introduced on July 1, 2013 to give taxpayers an opportunity to resolve an appeal or application for relief and avoid proceedings on such matters to the Special Commissioners of Income Tax.

The aim is to help taxpayers and the Inland Revenue Board (IRB) reach a out-of-court settlement, thus saving time and cost for both parties. The taxpayer can only access the DRP once an assessment has been issued and a Form Q (an appeal form) has been filed.

The DRP avenue can be found in many Commonwealth member countries. It consists of senior officials from the IRB who are entirely independent and not involved in the particular case under appeal. The DRP does not have anyone from outside the IRB.

Despite the absence of independent third parties from the DRP, it is still a useful forum for taxpayers to present and clarify their reasons for the appeal and a further opportunity to produce additional evidence to support their position to an independent team within the IRB.

What is taxpayers’ perception?

Sometimes, taxpayers have the perception that since there are no independent outsiders in the DRP, it is seen as another opportunity for the IRB to review its own position as to whether it has a case to pursue against the taxpayer. If it has a good case, the perception is that the DRP is likely to provide a decision in favour of the IRB. Is this true?

This perception may be unwarranted. Generally, the DRP tries very hard to listen to the taxpayer’s side of the case and attempts to mediate between the taxpayer and the team within the IRB dealing with the case. Effectively, they act more as facilitators and mediators between the two parties. They look at the case presented by the parties very thoroughly and spend significant time in attempting to bring the parties together.

How to prepare your approach to the DRP?

The taxpayer must prepare his case beyond what has been presented to the tax officers handling the case. He must take this matter seriously and prepare the case in a manner similar to what he would have done if he had gone to the courts. The level of evidence, the substantiation of case laws, documents to support the facts, and consolidating all this within the framework of the law, should be comprehensive and presented to the DRP from an honest standpoint.

The mode of presentation is equally important. Confrontational engagement would be unproductive. Usually, good results are achieved through reconciliation and compromise, and the experience is that the DRP will assist taxpayers achieve this goal where possible.

How can the DRP be improved?

The most important step to improve the credibility of the perception of the DRP would be to introduce an entirely independent member into the panel. The independent person should not be a staff of the IRB or a staff from the government sector.

The intention here is to eradicate the perception that the DRP is biased towards the IRB’s position and is just another internal mechanism to help the board vet the assessments. In reality, this is not the case, but perceptions will remain without independent members from outside the IRB fraternity.

PETALING JAYA: Lack of investment in cybersecurity leaves Malaysia vulnerable, according to Grant Thornton Malaysia country CEO Kishan Jasani.

He said insufficient cybersecurity investment in Malaysia, the third most breached country globally, poses risks to the public and the private sectors.

“Be aware. Plan. Take stock of what needs to be done. Execute. Have the actions in place. Implement them. For the government to actually have that confidence, to have that trust, to be able to assure the rest of the country, ‘Hey, it’s okay. We’ve got this’,” he said in an interview with SunBiz.

Kishan suggested collaboration between government and industry stakeholders to address vulnerabilities in Malaysia’s digital landscape effectively.

The call for urgent action comes as Malaysia grapples with increasingly sophisticated cyber threats ranging from data breaches to ransomware attacks.

“Other Asean countries are thinking very seriously because they know how secure these systems have to be,” said Kishan.

Recent incidents, including data breaches in government agencies such as the Central Database Hub (Padu) and financial institutions such as Maybank and CIMB, highlight the need for the measures, he added.

Wthout adequate investment and strategic planning, Kishan said, Malaysia risks economic and reputational damage from cyber incidents.

“Cybersecurity is a hot topic nowadays. The pretext of it is Padu. With our data going online, and the government is pushing for digitalisation. Also as part of the MSC status. So, cybersecurity is coming on trend,” he said.

Furthermore, Kishan highlighted the importance of education and awareness on cybersecurity for the public.

“From a personal level, it’s common sense. Keep things in a normal place, download from a reputable app store, don’t open suspicious links, don’t pick up random calls. Education is free,” he said. However, while people may possess knowledge about cybersecurity best practices, there is often a failure to put that knowledge into action effectively, he added.

CIMB Securities eyes high single-digit growth in market share by year-end

IRS Penalty for Underpaying Personal Taxes to Remain at 8%

The penalty for underpaying your taxes will not increase in July — though it remains steep. The IRS announced this week that the interest rates it charges for underpayments will remain the same for the third quarter of 2024 — July 1 to Sept. 30 — as they have been since the fourth quarter of 2023.
