Tax Matters – Corporates, do not overpay your taxes

OVERPAYING your taxes will not earn any brownie points with the!! tax authorities. Paying extra taxes adds to the authorities’ burden to monitor the overpayments as there have been cases where the refund mechanism was abused by taxpayers.

Since the officials will be held accountable for any errors, there is a tendency for them to be extra careful, which results in extra scrutiny somewhat similar to an audit. This is unwarranted as there is no connection between a tax refund and an audit.

The grouse of corporates is that the tax refunds are unnecessarily being held back which could have been ploughed back into the business operations without them having to incur interest to finance their capital needs.

The government wants to have a good relationship with taxpayers, and their desire is to increase the level of compliance by the taxpayers and enhance the sustainability of the tax collections for the nation. If this is the intention, holding back refunds for long periods will lead to a deterioration of the relationship with taxpayers.

Why is there overpayment?

Overpayment of taxes is a result of genuine willingness of the taxpayers to be on the right side of the law and to avoid penalties. The most common reason for overpayment is that corporate taxpayers cannot accurately forecast their future profits.

Currently our income tax system requires taxpayers to forecast their taxes one year in advance to enable the authorities to collect the taxes in advance on an instalment basis. You are given an opportunity to revise your estimates on the 6th, ninth and eleventh month of the financial year. However, in the first six months, you are forced to accept an instalment plan that cannot be less than 85% of the previous year’s estimate. This causes major problems because within the first six months, under the existing rules, you cannot amend the estimates although your profits have significantly dived, or your business has ceased in the first six months.

The profit fluctuation is very common in industries dealing with commodities where the prices fluctuate significantly, or in other industries where the demand for their product and services is affected by seasonal factors, competition, currency changes, technological changes, death of key personnel and other reasons, such as the revision of tax computations subsequently due to incentives or changes to the tax positions which are approved subsequently.

What is the current situation?

The Inland Revenue Board (IRB) has made it clear that refunds will only be made over a four-year period unless the amounts are minimal. The general principle is to refund a maximum of 5% within the first year, 10% in the second and third year, and the balance of 65% in the fourth year. The current practice of the IRB is not to allow a setoff the overpayment against the advance taxes that are due currently.

Under the law, the IRB will compensate you 2% interest which will run 90-days from the date the tax return is submitted. Taxpayers are more interested in obtaining the refunds than earning 2% from the IRB.

What should taxpayers do?

It is clear that taxpayers must not overpay their taxes, and it may be preferable if they underestimate their taxes despite the underestimation resulting in a penalty. The time incurred to obtain the refunds and the cost of money held back by the IRB is likely to exceed the penalty.

You are allowed to underestimate your forecast profits up to 30% below your liability without incurring a 10% penalty which will be imposed if you exceeded this threshold.

The holding back of refunds does not bode well for our tax system and dampens the relationship with taxpayers and foreign investors.

MDEC: AI Cities will be cornerstone of Malaysia’s digital future

KUALA LUMPUR: As Malaysia advances in its digital evolution, artificial intelligence-driven cities are taking centre stage – serving as dynamic hubs to attract investment, foster groundbreaking innovation and create equitable economic opportunities for all.

Malaysia Digital Economy Corporation (MDEC) CEO Anuar Fariz Fadzil shared the agency’s blueprint for transforming Malaysia from a regional technology hub into a globally respected digital economy over the next decade.

“Looking 10 years ahead, we see a Malaysia where AI integrates seamlessly into daily life, enabling equitable access to tools and opportunities. This future is about making cities more sustainable, citizen-centric, and competitive,“ he told SunBiz.

Anuar Fariz said this vision entails the responsible integration of AI, providing predictive and efficient public services and creating thriving smart cities that are both sustainable and people-focused. “Startups and SMEs will scale beyond borders, supported by robust infrastructure that drives inclusive, digital-led prosperity.”

Building on MDEC’s mandate to catalyse high-value digital growth and position Malaysia as a regional technology leader, Anuar Fariz said, AI Cities will be the cornerstone of the transformation.

“It will unite digital policy, innovation and public service to drive inclusive, competitive and sustainable growth, laying the foundation for Malaysia’s vision of becoming an ‘AI Nation’,“ he said.

Anuar Fariz said this vision not only elevates Malaysia’s leadership in AI development and adoption but also creates a scalable model for Asean, fostering cross-border collaboration, knowledge exchange, and regional digital resilience. “Through partnerships across the public, private, academic sectors, and the rakyat, Malaysia aims to amplify its impact across Southeast Asia’s digital economy.”

As part of its AI Cities initiative, MDEC is already implementing targeted, high-impact smart city pilots in selected locations, starting with Putrajaya.

“In Putrajaya, we are applying parametric modelling to simulate real-world urban scenarios. This allows us to test and refine planning decisions, improve service delivery, and optimise resource use,“ Anuar Fariz said.

He added that data from Putrajaya’s Urban Observatory is being used to develop an interactive AI-powered digital avatar capable of delivering real-time analytics for city planning and citizen engagement.

MDEC is also working closely with the National Artificial Intelligence Office (NAIO) to ensure that Malaysia’s AI growth is underpinned by strong governance and public trust.

“Trust is the foundation of digital adoption. Together with NAIO, we are developing a regulatory brief to guide the responsible use of AI, one that balances innovation with transparency, ethics and accountability,“ Anuar Fariz said.

These initiatives support Malaysia’s broader goals outlined in the Fourth National Physical Plan, Malaysia Digital Economy Blueprint, Asean Smart Cities Network and the upcoming 13th Malaysia Plan (2026–2030).

Anuar Fariz said MDEC’s goal is to catalyse future-facing, collaborative ecosystems where technology serves both people and progress.

“By embedding intelligence into how our cities are designed, managed and experienced, we’re not only building a smarter Malaysia, we’re laying the foundation for a resilient, inclusive and competitive digital nation that can lead the region,“ he added.

MDEC’s vision will take centre stage at the Smart City Expo Kuala Lumpur 2025 (SCEKL25), which will be held from Sept 17 to 19 at the Kuala Lumpur Convention Centre.

Themed “AI Cities: Shaping Our Digital Future”, the event will serve as a platform for regional dialogue, innovation exchange and policy alignment with Malaysia’s Asean Chairmanship this year.

“As the first Southeast Asian edition of the globally renowned Smart City Expo World Congress, SCEKL25 will position Malaysia as a central hub for smart city development and digital leadership in the region,“ Anuar Fariz said.

The expo will bring together more than 2,000 delegates and 10,000 visitors, including global experts, city leaders and technology providers across sectors.

The agenda is built around four strategic pillars – AI cities, sustainable and resilient cities, digital entrepreneurship and economic development, and community empowerment through digital solutions.

SCEKL25 will also feature keynote sessions by renowned global figures, including Dr David Hanson, creator of Sophia the Robot, urban strategist Dr Alfonso Vegara and futurist Penny Wong, among others.

“These conversations will help shape the next decade of digital city-building, not just in Malaysia, but across Asean,“ said Anuar Fariz.

US factory struggles with Trump steel tariffs impact

BELCAMP: The sweltering summer heat at Independent Can’s Maryland factory contrasts sharply with the snowman-decorated metal containers taking shape on the production line. But the real tension stems from President Donald Trump’s steep steel tariffs, now doubled to 50%, which CEO Rick Huether says are wreaking havoc on his business.

Huether, 73, who began working at his family’s company at age 14, is determined to keep the nearly century-old firm afloat. However, Trump’s tariffs on imported steel and aluminum have complicated operations, forcing Huether to consider price hikes of over 20%.

“We’re living in chaos right now,“ Huether told AFP. The factory, which employs nearly 400 workers across four sites, relies heavily on imported tinplate—a steel variant coated with tin to prevent rust. Yet, US production meets only 25% of the demand, leaving manufacturers like Independent Can dependent on foreign suppliers.

While Huether supports strengthening US manufacturing, he criticizes Trump’s unpredictable tariff policies. “Those all require us to buy in the neighborhood of 70 percent of our steel outside of the United States,“ he said. The tariffs have already led to a 20-25% drop in orders as customers brace for economic uncertainty.

The company’s Iowa plant shut down last year partly due to earlier tariff hikes. Now, with costs soaring, Huether fears history may repeat itself. Some buyers are shifting to American-made products, but Huether remains skeptical. “During the pandemic, we took everybody in... our business went up 50 percent,“ he said. Yet, post-pandemic, clients returned to cheaper Chinese alternatives.

Huether insists on long-term contracts to mitigate risks. “We need to have a two-year contract,“ he said. Despite the challenges, he remains hopeful. “I think that our business will survive,“ he added, though navigating the next six months remains uncertain.

Nvidia insiders sell $1 billion in stock amid AI-driven market surge

CALIFORNIA: Nvidia insiders sold more than $1 billion (RM4.22 billlion) worth of company stock in the past year, with a significant portion occurring this month as the chipmaker’s shares soared to record highs, the Financial Times reported.

Over $500 million of these sales took place in June alone, coinciding with Nvidia’s stock surge driven by investor enthusiasm for artificial intelligence.

Chief Executive Jensen Huang began selling shares this week for the first time since September, according to SEC filings. Nvidia’s stock reached an all-time high on Wednesday, briefly making it the world’s most valuable company. Analysts attribute the rally to the AI boom, with one describing Nvidia as riding a “Golden Wave” of artificial intelligence.

The company’s rebound follows a 60% recovery from its April low, when markets reacted to global tariff announcements. U.S. stocks, including Nvidia, have since regained momentum amid expectations of trade deal resolutions. Nvidia did not respond to Reuters’ request for comment.

Tax Matters – How should businesses prepare for Sales and Service Tax expansion?

ALL businesses will be affected directly or indirectly by the significant expansion of the Sales and Service Tax (SST) regime which will become effective from July 1. This will flow through to the businesses either through the removal of about 3,400 items from the sales tax exemption list to the 5% and 10% categories, and through the introduction of six new taxable services.

Unless the businesses are the final consumers of these goods and services, theoretically the role of the businesses would be to act as tax collectors for the government. In practice, inevitably some portion of the tax collected will be borne by the businesses as they will not be able to pass on the cost.

Since services such as construction, finance and rental are integral to almost every industry sector, the tax increase in these areas will percolate or spread throughout the business ecosystem.

What are the steps businesses should now undertake?

Before July 1, businesses should review their supply chain and look at the impact of the SST changes on all the inputs and outputs of the business. This step will immediately give you an idea of the increased cost to doing business which will then lead you to determine whether you can increase and pass on the cost to customers. At this stage, you will be looking at reducing the cost through substitution with products and services that are not affected by the changes, or reduce the consumption of the taxable products and services.

The next step to keep your costs at the same level would be to identify all the possible exemptions and deductions in the sales tax regime and similarly identify the exclusions and exemptions for service tax regime. Here, the focus should be to take advantage of the business-to-business exemption for services, and to benefit from the exemptions available for goods.

In the bigger picture when you are looking at managing the overall cost to the business, you should take into account exclusions, deductions and group reliefs.

For businesses that are not registered, you need to quickly assess whether the thresholds stated for the different services will be exceeded within the next 12 months to be calculated from July 1. The thresholds vary for different services from nil to RM500,000 and to RM1.5 million.

Similarly, for sales tax purposes, new registrants should qualify as a manufacturer and exceed the sales threshold of RM500,000 for the next 12 months. Broadly speaking, manufacturing involves the transformation of materials or products from one state to another. Businesses should carefully assess whether their activities fall within the definition of “manufacturing” under the Sales Tax Act.

Importation of goods and services will attract imported sales tax and imported service tax. This is often ignored by the taxpayers largely because they are not registered for SST. A frequently used imported service could be financial services provided in the course of arranging financing for Malaysian companies. Another example would be leasing of assets by a foreign company to a Malaysian entity.

Businesses should also review their contracts spanning July 1 to determine whether they are non-reviewable, in which case, they will be eligible for a 12 months’ exemption from charging service tax.

You need to identify SME lessees whose turnover will be less than RM500,000 and therefore exempted from paying service tax on their rental. This can be done by checking the portal that will be available next week where such SMEs will need to register.

Businesses should ensure they do not breach the Price Control and Anti-Profiteering Act. For example, if you have leftover stock which has not been subjected to sales tax, you cannot increase your prices to reflect the increase that will be triggered from July 1.

The final advice is that if you are unclear on the definitions or any issues surrounding your transactions, it will be best to seek the views of the Royal Malaysian Customs Department in writing to avoid future disputes with them. This should be done before July 1 or as soon as possible.

MIER struggling to stay afloat, says chairman

KUALA LUMPUR: After four decades of shaping Malaysia’s economic and social policies, the Malaysian Institute of Economic Research (MIER) is now struggling to stay afloat.

MIER chairman Tan Sri Effendi Norwawi said MIER – one of the country’s two independent think tanks alongside ISIS Malaysia – is now sustained not by public funds, but by personal contributions from its board of trustees.

“As trustees, we personally advance funds to keep operations running. We do this pro bono because we are deeply passionate about ensuring MIER continues to serve its national role,” he told SunBiz in a recent interview.

Once the go-to source for independent data behind the Malaysia Plans and industrial blueprints, MIER now operates with zero core funding. Its annual government grant? Gone. Its project pipeline? Shrinking. Its staff? Whittled down after years of financial strain.

Without regular government grants, Effendi said, MIER is surviving only because its board members are personally funding it.

“We used to receive an annual grant. That stopped. While we’re still in talks with the government, in the meantime, we’ve had to raise our own funds.”

He said the board is now mostly focused on survival, meeting weekly just to manage basic sustainability.

“There were times we ran out of money. When that happens, we step in ourselves. The board meets almost every week now just to ensure MIER stays alive,” he said.

Today, MIER is overseen by a board of trustees comprising former senior civil servants and industry leaders, including former Economic Planning Unit director-general Tan Sri Dr Sulaiman Mahbob; Royal Selangor founder and former Pemudah co-chair Tan Sri Yong Poh Kon; former Johor menteri besar Tan Sri Abdul Ghani Othman; former Treasury official and economist Datuk Dr M. Shanmughalingam; and Sarawak Deputy State Secretary (Economic Planning and Development) Datuk Sri Dr Muhammad Abdullah Zaidel.

Effendi said the current leadership is working unpaid, out of passion and duty. “We are only volunteers. We do our best. But if we’re unable to raise funds and keep MIER going, there’s a real risk we may not survive, which would be very sad for the country.”

Despite its financial strain, Effendi said, MIER remains actively engaged in policy work. It is currently advising the Ministry of Finance on the Sales and Service Tax and the Goods and Services Tax deliberations, and has submitted proposals to agencies such as Malaysian Investment Development Authority (Mida)

“Our input is valued because we’re close to industry and remain neutral. We engage as professionals.”

The institute is also in talks with state governments such as Sarawak and Terengganu and financial institutions including Affin Bank.

“We engage with these institutions to see how we can support them whether at the national policy level or in operational matters. For example, we produce GDP (gross domestic product) reports, consumer confidence and business indexes, which banks use to advise their clients.”

MIER is now planning a national economic conference in collaboration with Affin Bank, bringing together local and global experts.

“We hope to gather domestic and international voices to discuss the most pressing topics for national policy and business.”

The think tank will also continue to publish its quarterly reports.

“Our strength is our network. We have access to the best minds across fields, economic, social, sustainability, artificial intelligence, innovation thanks to our ties with universities.

“When the government gives us a task, we can deliver fresh insights backed by the country’s best thinkers.”

Effendi remains hopeful that MIER’s track record, independence and institutional memory will continue to be recognised and supported.

“This is the value MIER brings. This is our national role. We just want the chance to keep doing it.”

Former chairman Tan Sri Sulaiman Mahbob shared that the think tank has been facing long-standing financial difficulties and lacks a stable source of funding.

“We don’t have a permanent income or a fixed government provision for planning. If the government gives us something, it helps, but we still have to go out and find our own projects,” he told SunBiz.

He said MIER’s financial reserves were severely impacted by past economic crises, including the 1997–98 Asian Financial Crisis, the 2008–09 Global Financial Crisis and, most recently, the Covid-19 pandemic.

“Our endowment funds were placed with fund managers, but they were affected when the stock market collapsed,” he said.

“During Covid, we couldn’t carry out any projects for nearly two and a half years. People weren’t coming into the office, but we still had to pay rent, utilities and full wages.”

As a result, key staff left and many projects dried up.

“When we ran out of money, many directors resigned. Our core management team moved on. It’s not that we lost capacity – we just couldn’t afford to keep them,” he said.

Sulaiman noted that although the government continues to help, most recently with a RM1 million allocation, MIER’s long-term financial footing remains shaky.

“The government still helps, but differently now. If they need research, they fund it. If not, there’s no support,” he said.

“Private companies also don’t offer many projects anymore. They have their own in-house research teams. Banks, for instance, used to rely on us. Now they have economic departments of their own.”

Even so, he said, demand for independent voices is growing again as the economy becomes more complex and volatile.

“People are starting to come back to us. They want a balanced view, not just the official government narrative, but also a private, independent one.”

Sulaiman believes Malaysia urgently needs more independent research bodies to keep national economic debates diverse and robust.

“We only have two think tanks – ISIS and MIER. But ISIS is government-funded. MIER is the only truly independent one.

“Other countries like Singapore, Indonesia, the Philippines have many. We need at least five or six independent think tanks to give fresh, competing perspectives.”

He said the private sector should also step up to support institutions such as MIER.

“Companies that benefit from a strong economy like oil, palm oil, manufacturing should help us. There are tax incentives for donations. But they’re not coming forward.

“Saying the government no longer helps isn’t accurate. They still help. But the private sector is lagging. It needs to do more.”

For Malaysia to make better long-term decisions, he said, there must be room for more than one voice.

“Right now, we rely on a single source. That makes it harder to respond to new challenges. We need more free-thinking institutions to offer alternative forecasts, models and solutions.”

“That’s why MIER must continue to exist. It’s one of the last independent voices in the country.

Arisprop aims to bring Aris Burger to China by 2027

KUALA LUMPUR: Frozen food manufacturer Arisprop Capital Bhd is planning to introduce its Aris Burger brand to the Chinese market by 2027, as part of the company’s global expansion strategy.

Its managing director, Datuk Haris Embong, said the company is currently focused on strengthening its domestic business foundations, including supply chain optimisation, product quality and operational processes, before venturing internationally.

“We want to export our products overseas, possibly to China by 2027 or even earlier. But first, I want to reinforce our domestic foundation, as demand is high,” he said during Bernama TV’s Bual Bisnes programme on Saturday.

The company is also planning a business visit to China as an initial step towards establishing export partnerships to support market expansion into the country.

In addition to China, Malaysian halal products are attracting strong interest from other countries, including Japan and Indonesia, and the Middle East, Haris said.

To strengthen its product line-up, the company is in the final stages of developing a ready-to-eat burger, which is expected to be the first of its kind in Malaysia.

“This ready-to-eat burger is the result of Arisprop’s research and innovation, and we anticipate strong demand in the local market,” Haris said.

All Aris Burger products have received the necessary certifications and approvals from agencies such as the Department of Islamic Development Malaysia, the Ministry of Health Malaysia, and the Department of Veterinary Services, positioning the company to compete on a global scale. – Bernama
