Malaysia secures RM230 million in palm oil deals at China trade event

KUALA LUMPUR: Malaysia has secured more than RM230 million in palm oil trade deals at the 15th China International Cereals and Oils Industry Summit in Nanjing.

Further, four memorandums of understanding (MoU) were signed between Malaysian palm oil companies and businesses at the event, which took place on July 11.

Two of the four MoU signed are between Kuala Lumpur Kepong Bhd (KLK) and BOCE Trade Service Co Ltd for tocotrienol exports, and between Taobao (China) Software Co Ltd and Able Perfect Sdn Bhd for expanding digital market access. The other two were Taobao (China) Software and Sawit Kinabalu Sdn Bhd for crude palm oil (CPO) trade, and JF Nutritech Sdn Bhd and Palmort Food Tech (Shanghai) for the application of red palm oil in animal feed.

Deputy Plantation and Commodities Minister Datuk Chan Foong Hin was on a working visit at the event to promote Malaysian agricommodities in China. He witnessed the MoU signing ceremony together with Malaysian Palm Oil Board (MPOB) director-general Datuk Dr Ahmad Parveez Ghulam Kadir, accompanied by China Chamber of Commerce for Import/Export of Foodstuffs, Native Produce and Animal By-products president Cao De Rong.

“Able Perfect, an independent palm oil refinery based in Port Klang, aims to expand its presence in the Chinese market, particularly in refined palm oil and palm shortening, with an estimated business volume of about RM200 million through this trade deal,“ Chan said.

He highlighted that the MoU aim to expand the palm oil products trade into new sectors.

This includes leveraging the globally renowned e-commerce platform Taobao to develop online business-to-business and business-to-consumer sales channels, and entering the health product market with tocotrienols, a potent form of vitamin E derived from palm oil.

The initiatives mark a significant milestone for Malaysian palm oil enterprises.

Chan emphasised that Malaysian companies must focus on high-value-added and high-quality productions to remain competitive in the global market.

With Malaysia’s annual palm oil production maintained at around 18 million tonnes, it is crucial to adhere to the European Union Deforestation Regulation standards and sustainable development principles, he said.

Palm oil is one of the most versatile and efficient vegetable oils, with diverse and easily processed characteristics, providing significant advantages and opportunities for research and development (R&D) and product innovation.

Chan said the Chinese authorities approved the export and use of palm tocotrienols in food applications in March this year. Thus, the overall value of these trade deals is expected to increase in the coming years.

Chan also held a business matching session with around 20 Malaysian and Chinese enterprises, providing a platform for exchange and exploring cooperation opportunities in the palm oil trade. He said these initiatives will deepen bilateral cooperation in the palm oil sector, promoting mutual economic prosperity and win-win outcomes for Malaysia and China.

Tax Matters – Importance of contemporaneous documentation

ALL business transactions should be supported with proper and comprehensive documentation that should be prepared on a contemporaneous basis (i.e. at the time the transaction is taking place, or immediately after the transaction has occurred).

The contemporaneous nature of documentation is not confined to transfer pricing documentation where the law specifically requires it to be “contemporaneous”.

The importance of documenting the transactions at the time they occur is that the parties concerned will be fully aware of the facts and therefore will reflect the authenticity of the underlying facts and circumstances leading to the transaction. Any challenge by the Inland Revenue Board (IRB) on the facts can be easily defended. The volume of documentation will vary from the simple one-off buy-sell transaction to the complex business reorganisation.

Why is it important?

The need to produce the documentation for taxation purposes only comes up when IRB initiates an audit or investigation. It is not uncommon for IRB to take the position where a tax deduction may not be allowed, or a capital receipt is subject to income tax, or the timing of the taxation could be an issue.

Preparing documentation should cover the whole spectrum of the transaction. In any new arrangement between third parties or more importantly between related parties, a starting point will be the correspondence that would have taken place before a contract was entered into, and thereafter the need to memorialise the arrangement into a contract document which will reflect the intention of the parties.

The underlying documents supporting the transaction also need to be supportive of the contract and this will include the description in the accounting entries, documents such as purchase orders, invoices, customs documentation, etc. All documents should be aligned to reflect the true nature of the transaction and, secondarily, it is important that in the case the transactions involve other regulations such as Bank Negara Malaysia applications, Malaysian Investment Development Authority incentive applications, or other applications to various bodies such as Malaysia Digital, etc. These applications should not conflict with the underlying nature of the transaction.

In the case of related parties, significant amount of documentation is prepared for transfer pricing purposes and the information contained therein can lead to conflicts if this is prepared in isolation without reflecting on the original nature of the transaction. For example, if the taxpayer is arguing that he is a limited risk distributor and he is attempting to claim advertising expenses that should have been borne by the principal, the deduction can be denied on the basis that there is a conflict of evidence.

The importance of evidence becomes clear in cases where disputes arise between the treatment of real property gains tax and income tax, claims for reinvestment allowances or capital allowances, difference between domestic source and foreign source income, characterisation of the parties in a transfer pricing arrangement, and the difficulty in distinguishing the simple fact between capital and revenue in a transaction that involves the sale of a business or a portion of the business.

This is just the tip of the iceberg and there are many more transactions that will give rise to disputes between IRB and taxpayer, and the cornerstone of defence for the taxpayer is both the application and interpretation of the law, and the supporting comprehensive evidence which will be the pillar to support the facts and circumstances of the transaction.

IRB officials will do their jobs by scrutinising the the authenticity of the documents supporting the taxpayer’s position. The suspicion of IRB is always whether the documents are prepared on a “post-basis” at a much later date closer to the date the audit is initiated. In simple terms, IRB wants to know whether the taxpayer has concocted a story as an afterthought. At the start of any investigation or audit, the taxpayer should be honest and should not provide any leeway for IRB to have such suspicions.

Matrade confident Malaysia’s halal exports will reach RM65b by 2025

KUALA LUMPUR: Malaysia’s halal exports are expected to reach RM65 billion by 2025, up from RM54 billion in 2023, according to Malaysia External Trade Development Corporation (Matrade).

Matrade deputy CEO (export acceleration) Abu Bakar Yusof said the confidence is driven by growing global demand for halal products and Malaysia’s position as one of the leaders in the halal market.

“The forecast for the halal products market is to reach US$5 trillion (RM23.3 trillion) by 2030. Last year, the halal economy was US$3 trillion. There is a lot of room for Malaysia to capitalise on these opportunities. Malaysia has the advantage because our Jakim (Department of Islamic Development Malaysia) halal certification is highly recognised and much sought after by the international business community,” Abu Bakar told SunBiz in an exclusive interview.

He mentioned that Malaysia’s strength in the global halal market comes from its innovation, research and development efforts and collaboration with international partners.

“Currently, our focus is on the high-value-added food and beverage (F&B) industry, catering not only to domestic consumers but also to the global market.”

Abu Bakar said high-value F&B products undergo significant transformation compared to traditional items, integrating advanced technologies, rigorous research and quality control measures. “This transformation not only enhances product quality but we can also position these goods at premium price points for the medium and high end market.”

Malaysia’s success stories in halal exports include products such as durians and birds’ nests, with China emerging as a key consumer market, he said. “Our durians and birds’ nests exemplify Malaysia’s capacity to leverage high-value products in international trade.”

Moreover, Abu Bakar said, the halal high-value F&B products align with sustainability and environmental, social and governance principles.

“Companies that integrate sustainable practices throughout their supply chains, from sourcing raw materials to packaging and distribution, not only appeal to environmentally conscious consumers but also enhance their market competitiveness,” he added.

Abu Bakar noted that Malaysia has about 10,000 companies certified by Jakim for halal standards, primarily in the F&B sector.

“The goal is to expand this certification base further where halal certification not only meets religious requirements but also aligns with global sustainability demands. This is where we encourage our producers, local producers and manufacturers to go into more research R&D and also innovation, automation so that they can cater for these international requirements,” he said.

Malaysia’s growth in halal exports is also driven by sectors such as pharmaceuticals and cosmetics, which are seeing increasing demand from countries in the Middle East, Europe and Asia, Abu Bakar said.

“The global halal industry is experiencing robust growth driven by consumer awareness and demand for products that adhere to Islamic laws,” he said.

Being halal does not only cover the slaughtering of animals, it encompasses the entire supply chain.

“We have both food and non-food to cover as halal products. That’s why the total halal export figure is bigger than only processed food. Processed food was RM30 billion last year, while total halal RM54 billion last year because it covers non-food as well,” he explained.

Abu Bakar said halal includes ensuring adherence to sustainability standards, hygiene practices, and rigorous facility inspections. “Even the logistics play a role, with dedicated Halal logistics providers ensuring that products maintain their integrity throughout transportation.”

Berjaya Sompo launches ‘The Good Riders: MotoCheck’ drive in tie-up with iMotorbike

PETALING JAYA: Berjaya Sompo Insurance Bhd has launched “The Good Riders: MotoCheck” campaign in partnership with iMotorbike, Southeast Asia’s leading motorcycle platform for buying and selling preowned motorcycles.

The initiative is a concerted effort to promote the importance of motorcycle maintenance and road safety among Malaysian riders besides aiming to enhance motorcyclists’ safety on the road while underscoring the necessity of regular servicing.

The campaign was launched following statistics by the Malaysia Road Transport Department in 2023 having recorded 6,344 fatalities in road accidents, with about 63% involving motorcycles.

In response to the statistics, Berjaya Sompo introduced The Good Riders: MotoCheck to address the alarming rate of fatal motorcycle accidents through education while emphasising the critical role of motorcycle maintenance.

The campaign is an initiative that reinforces Berjaya Sompo’s commitment to ensure road safety for all by highlighting the significance of safe riding practices among motorcyclists in Malaysia.

It is also part of “The Good Policy”, Berjaya Sompo’s environmental, social and governance (ESG) initiative that has organically evolved from a foundational commitment into a dynamic catalyst for change.

To enrol in this campaign, consumers need to download and sign up for the MySOMPO app. After signing up, they can fill out the enrolment form within the app. Participants will receive a complimentary RM50 voucher for engine oil replacement and motorcyle inspection at iMotorbike HQ in Glenmarie, Shah Alam.
